Terms Of Service


Welcome to Grab the Bites. This page (together with the documents referred to in it) tells you the terms (the “Terms”) which apply when you order any menu items (the “Items”) from our grabthebites.com, grabthebites.ae website or mobile applications and related services (each referred to as an “Application”).

By entering, connecting, using or creating an account on this website and its associated applications on iPhone, iPad, Android, and any mobile application (hereinafter collectively referred to as the "Platform") including without limitation to any services offered on the Platform, you acknowledge that you have read and understood the following Terms and Conditions (collectively the “Terms"),

You become a user of the Platform ("User" or "you"), by entering, using, browsing or registering on the Platform. As a User, you agree and undertake to comply with the provisions of these Terms. Please read these Terms carefully before ordering any Items from our Application. You are responsible for making all arrangements necessary for you to have access to the Platform. You are also responsible for ensuring that all persons who access the Platform through your Internet connection are aware of these Terms and that they comply with them. By viewing, using, accessing, browsing, or submitting any content or material on the Platform, you agree to these Terms as a binding legal agreement, without limitation or qualification. The term "you" or "You" shall include any person or entity, who views, uses, accesses, browses or submits any content or material to the Platform.

If you do not agree to these Terms, then you may not use the Platform. Grab The Bites reserves the right to modify these Terms at any time without prior notice. You agree that each visit you make to the Platform shall be subject to the Terms as displayed, and your continued use of the Platform now or following the modifications in these Terms confirms that you have read, accepted, and agreed to be bound by such modifications. If you have any questions relating to these Terms, please contact support@grabthebites.com before you place an order. If you are a user, you have certain legal rights when you order Items using our application. Your legal rights are not affected by these Terms, which apply in addition to them and do not replace them.  By setting up your Grab the Bites account, you confirm that you accept these Terms.

Platform is operated in the United Arab Emirates by Grab the Bites management of Delivery LLC (“we”, “us” or “Grab the Bites”), incorporated in the Dubai, United Arab Emirates, with Trade license 1133974

The Platform allows its Users who agree to the Terms to order from its partnered restaurants, vendors, groceries etc. that may be operated by third parties or affiliated companies (hereinafter referred to as the "Merchants").

Our objective & purpose is to link you to the restaurants, Grocery Stores and others we partner with (Merchants ") and allow you to order Items for delivery (our “Service”). Where you order from a Partner Restaurant, Grab the Bites acts as an agent on behalf of that Merchant to conclude your order from our application and to manage your experience throughout the order process. Once you have placed an order, your Items will be delivered to you by Grab the bites (“GTB DRIVE”) or our Merchant own drivers directly (“Merchant Delivery) (each a “Delivery”) depending on the Partner Restaurant you have selected. In some cases, the Partner Restaurant may be owned by or affiliated with us.    

The purpose of this Platform is to provide a simple and convenient service to Users, linking them to Merchants in their area for delivery (our "Service") to order a variety of goods including prepared meals, beverages, non-prepared food and miscellaneous non-food items (hereinafter collectively referred to as "Goods").

Grab the bites does not sell or interfere in any way in the production of any goods or service produced by the Merchants.  What this online market offers to the Users is the ability to search for and find local Merchants that deliver or make these Goods available to their addresses and enables ordering them through this Platform. The Merchants are obligated to comply with the country's local laws, rules, regulations, and standards pertaining to goods and services preparation, sale, marketing and safety.

User must understand that we do not in any way independently verify the credentials, representations or products of Merchants, the ingredients or the quality of any products, or that a Merchant is in compliance with applicable laws. Users must make themselves comfortable through information provided by Merchants on the Platform or as requested by Users directly from the Merchants as to the quality and reliability of the Merchants, as well as to their compliance with applicable laws.

  • Grab the Bites does not in any way guarantee the quality of any Goods
  • Grab the Bites does not in any way guarantee Goods complies with applicable laws
  • Grab the Bites does not in any way guarantee matching the list of Goods displayed on the Platform to what is actually provided to the Users.

Merchant may represent those goods and services preparation is in accordance with special standards, for example (including without limitation) to "organic," "macrobiotic" or allergen-specific standards, for example (including without limitation) "nut-free", "gluten-free", or "lactose-free".

  • Grab the Bites is not obligated to provide ingredient information or allergen information on the Platform.
  • Grab the Bites does not guarantee that the Goods sold by Merchants are free of allergens, unless otherwise required by applicable laws.
  • Grab the Bites does not independently investigate or verify such representations.

If you have allergies, allergic reactions or dietary restrictions and requirements, please contact the Merchant before placing an Order on our Platform. Grab the Bites and the Merchants (as the case may be) reasonably endeavor to comply with your special instructions for an Order. However, in some cases where this is not feasible, possible or commercially reasonable, Grab the Bites and/or the Merchants reserve the right to proceed to prepare the Order in accordance with standard operating procedures. Neither Grab the Bites nor the Merchants shall be responsible to replace or refund an Order which does not conform to special instructions provided by you. Grab the Bites is not accountable for any products or services provided by Merchants that may be harmful to health, cause injury, be deemed unsatisfactory by Users, or fail to meet Users’ expectations in any way.

Delivery

When placing an order, you will be given the option to select either an "ASAP Delivery" or a "Scheduled Delivery." For ASAP Deliveries, an estimated delivery time will be provided prior to order confirmation; however, delivery will be attempted at the earliest possible opportunity. Accordingly, you are expected to be available to receive the order from the moment it is placed. For Scheduled Deliveries, a specific delivery window will be communicated in advance. You are required to be available to receive the order from ten minutes before until ten minutes after the stated delivery time. Despite the best efforts of both our team and our Partner Restaurants, unforeseen circumstances such as traffic conditions or adverse weather may occasionally impact our ability to deliver within the anticipated timeframe. Should your order be delayed by more than 20 minutes without prior notification and without an opportunity provided to cancel the order, we will take appropriate steps to resolve the matter—provided that the delay was not caused by factors attributable to you, such as the provision of an incorrect delivery address or failure to be present to accept the delivery.

Users are entirely responsible for ensuring the accuracy of the delivery address they provide, and Grab the Bites will not be held responsible for any mistakes related to incorrect addresses. The preparation and delivery of all items are handled solely by the Merchant fulfilling the order. Please note that while Merchants will make every effort to deliver orders within the promised timeframe, delays may occur due to circumstances beyond their control. If any unexpected delay arises, we will notify you as soon as possible.

We will attempt delivery at the address you provide to us when you place your order. If you need to change the delivery location after you have placed your order, we may be able to change to the address to an alternative one that is registered with your account if you let us know before the driver has been dispatched, and the new address is within the same zone as the address you originally ordered your Item to. If we cannot change the delivery address, you have the option to cancel the order, but if food preparation has started you will be charged the full price for the Item, and if the driver has been dispatched you will also be charged for delivery. You will still be charged for the Item and for delivery in the event of a failed delivery if you have caused such failure for any reason. Reasons you might cause a delivery to fail include (but are not limited to):   

  • cause a delivery to fail if you do not come to the door
  • cause a delivery to fail if you did not pick up the phone when the driver contacted you using the contact information you have provided us; and/or
  • cause a delivery to fail if you picked up the phone but then failed to provide access within a reasonable amount of time within 5 to 10 minutes bracket, and the driver is unable to find a safe location to leave the food.

Your account

Before you can place orders for Items using our platform, A User can create an account on the Platform and can determine their own "username" and "password" which are determined by the User herself/himself. or other secure login method and may also have to provide credit card details. You must keep any password you create, or other secure login method, secret, and prevent others from accessing your email account or mobile phone.

If another person uses these methods to access your account, you will be responsible to pay for any Items they order, and we are not responsible for any other losses you suffer, unless the person using your password obtained it because we did not keep it secure.

By using this Platform, you warrant that any personal information provided by you is true, accurate, current and complete in all respects and that you will notify us immediately of any changes to your personal information by updating your User profile on the Platform or by contacting us, you agree not to impersonate any other person or entity or to use a false name or a name that you are not authorized to use.

You may close your account at any time by requesting to do so in your account section of our website or contacting us using the contact details above. We may suspend your access to your account, or close it permanently, if we believe that your account has been used by someone else. We may also close your account if in our opinion you are abusing our Service (for example, by applying for refunds or credit to which we do not consider you are entitled, making repeated unreasonable complaints, mistreating riders, or any other good reason). If we close your account permanently, we will refund any remaining account credit you have validly obtained from our customer service team or Application following any issue by applying a credit to your registered credit card, or if that is not possible for any reason, by way of a bank transfer using bank details (provided you have supplied them to us).

  • The user can change the password at any time.
  • You are not allowed to register multiple Accounts for use by the same person. Violation of this clause may result in termination of your account.
  • Your device should hold one User account only. We may allow service in some cases, but we will not allow the use of promotions.
  • It is solely under the responsibility of the user to select and protect the password.
  • Grab the Bites is not liable for any problems, which may arise from the use of password.
  • Grab the Bites informs the user about the promotions, which take place in the user's area and from which the user may benefit, by emails.

You may not use the Platform for any unlawful or unauthorized purpose, including without limitation to: Distributing any unlawful, libelous, abusive, threatening, harmful, obscene or otherwise objectionable material. Transmitting material that constitutes a criminal offense, results in civil liability or otherwise breaches any laws, regulations or codes of practice. Interfering with any other persons use or enjoyment of the Platform. Damaging, disabling or impairing the operation of this Platform or attempting to gain unauthorized access to this Platform or to networks connected to it, through hacking, spoofing or other such similar means.

Grab the Bites may share your username and password with the third-party companies for the purpose of providing our Service – for example, the phone number may be shared with the Merchant which deals with take-out goods and services, in order to provide a faster and correct delivery. For the user to connect to the services, which require an Account of the Platform, the user must enter the username and password. This process is called "login" to the Platform or application. If you wish to delete your Account, please contact us via the Platform or application feature requesting the same.

Orders & Service

Once you have selected your Goods place an order from the list of your chosen Merchant you will be given the opportunity to submit your order by clicking on the "Checkout" button (the "Order"). We will send you a notification if your order has been accepted. Please note it is important that you check the information that you enter and correct any errors before clicking on the "Checkout" button since once you click on this input, errors cannot be corrected. On receipt of your order, the Platform will begin processing your order and we will send an email and message on the final page that your order has been received and sent successfully to the Merchant. All Items are subject to availability. Partner Restaurants may use nuts or other allergens in the preparation of certain Items

  • Any payment you make is not authorized or declined you will be returned to the previous page on the Platform, and we shall not be obliged to provide the services.
  • Grab the bites and merchant Restaurants operate a minimum order value policy.
  • The contract for the supply of any Item you have ordered comes into existence when we send the Confirmation Notice.
  • You are responsible for paying for all Items ordered using your account, and for related delivery charges, and for complying with these Terms

Delivery

You understand that the available goods offered by on platform may vary from delivery area to delivery area. By entering your delivery address on the Platform, you will see the Vendors that we make available to you at that time. Each merchant has a prescribed delivery area. This delivery area may change at any time due to factors such as weather, or demand on our service. Our merchant each decide their own operating hours. That means that the availability of our Service, and the range of merchant from which you can order, depends on the merchant in your area. If you try to order a delivery to a location outside the delivery area or operating hours of a Partner Restaurant, or the Application is otherwise unavailable for any reason, we will notify you that ordering will not be possible.

  • Contact our merchant prior to ordering if you have an allergy. Grab the bites cannot guarantee that any of the Items sold by our Partner Restaurants are free of allergens.

When you place an order, you will have the choice to place it as an ASAP Delivery or a Scheduled Delivery. For an ASAP Delivery, we will tell you an estimated delivery time for your Item before you place the order, but we will attempt delivery as soon as possible; you must therefore be available to accept delivery from the time you place the order. For a Scheduled Delivery, we will tell you the time when the Item is expected to be delivered; you must be available to accept delivery for ten minutes before and ten minutes after that time.

Without prejudice to any other clauses in these Terms, in cases where we attempt to deliver an Order, but we are unable to do so due to the reasons caused by you, including but not limited to:

  • No one was present or available to receive the Order.
  • Customer was uncontactable despite attempts to reach the customer via the phone number provided.
  • Lack of appropriate or sufficient access to deliver the Order successfully.
  • lack of a suitable or secure location to leave the Order.

Unfortunately, despite our, and our Partner Restaurant’s best efforts, things do not always go to plan and factors such as traffic and weather conditions may prevent us from delivering your Item on time. If your order is more than 20 minutes late, and we haven’t notified you giving you the option to cancel your order, we will work with you to make things right unless you have caused the delay. If you need to change the delivery location after you have placed your order, we may be able to change to the address to an alternative one that is registered with your account if you let us know before the driver has been dispatched. If you remain uncontactable or fail to receive the Order within reasonable time from the time the Order arrives at your delivery address, Grab the Bites reserves the right to cancel the Order without refund or remedy to you. Upon receipt of your Order, if you discover that there are issues with your Order (e.g. wrong order, defective order, or missing items) please contact customer support via our in-app customer support feature or phone call immediately. In some cases, Grab the Bites may request for photographic proof and/or additional information to properly investigate the issue with your Order. If we determine that the Order and/or goods you received are not of satisfactory condition or quality, we will compensate you for your Order or parts of your Order.

When you place an order, you will have the choice to

  • place it as an ASAP Delivery or pickup
  • or a Scheduled Delivery or pickup

For an ASAP Delivery, we will tell you an estimated delivery time for your Item before you place the order, but we will attempt delivery as soon as possible; you must therefore be available to accept delivery from the time you place the order. For a Scheduled Delivery, we will tell you the time when the Item is expected to be delivered; you must be available to accept delivery for ten minutes before and ten minutes after that time.

Grab the Bites or Merchant driver shall deliver your Order to the delivery address provided by you. An estimated delivery time will be provided to you in your email confirmation as well as on the order tracking page. However, delivery times shall vary depending on factors that are not controllable (e.g. order quantity, distance, time of day (peak periods), weather conditions, traffic conditions, etc.). You can view the remaining delivery time of an Order when you click on ‘My orders' on the Platform. You acknowledge that the delivery time we provide is only an estimate and Orders may arrive earlier or later. To ensure that you do not miss a delivery of an Order, you should ensure that either you or someone is at the delivery location to receive the Order once an Order is placed. If your Order is significantly delayed from the estimated delivery time, please contact customer support immediately.

You have a legal right to receive goods which comply with their description, which are of satisfactory quality, and which comply with any specific requirements you tell us about (and we agree to) before you place your order. If you believe that the Items you have been delivered do not comply with these legal rights, please let us know. We may request a photograph showing the problem if it is something that can be seen by inspecting the Items. We will provide a refund or account credit in respect of the affected part of the Item, and also in respect of delivery if the whole order was affected, unless we have reasonable cause to believe that the problem was caused after delivery

Prior to processing your refund or account credit, we may consider relevant factors including the details of the order, including your account history, what happened on delivery and information from the Partner Restaurant.

In case of Contactless Delivery instructions by user, the customer may select (for some of the offered goods) contactless delivery (the delivery of the Order to the front door of a specified delivery address without face-to-face interaction for instance). Grab the Bites shall not be liable for theft, damage, contamination and/or other deterioration of the goods that occur after delivery has taken place. You have the option to cancel the order, but if food preparation has started you will be charged the full price for the Item, and if the driver has been dispatched you will also be charged for delivery. You will still be charged for the Item and for delivery in the event of a failed delivery if you have caused such failure for any reason. Reasons you might cause a delivery to fail include (but are not limited to):   

  • you do not come to the door.
  • did not pick up the phone when the driver contacted you using the contact information you have provided us; and/or
  • you picked up the phone but then failed to provide access within a reasonable amount of time, and the driver is unable to find a safe location to leave the food.

Pickup Order

If the option is available on the app or website, you can choose to pick up your order from the store instead of having it delivered. Your confirmation email will tell you what time your order will be ready ("Collection Time"). The store will try to have it ready by then, but there might be a small delay. The store will hold your order for up to 30 minutes after the Collection Time ("Holding Time"). If you don’t pick it up within that time, they don’t have to give it to you. If you’re late, and the food gets damaged, spoiled, or is no longer safe to eat (for example, due to temperature changes), it's your responsibility. You won’t get a refund or replacement. It’s also your job to check your order when you pick it up. If there’s a problem, tell the store right away before you leave.

Cancel order

You are allowed to cancel your order at no cost, as long as the restaurant has not yet started preparing the food (this is called a “Processing Order”). If you want to cancel your order before the preparation begins, please contact us right away through our app or phone call. Once we confirm with the restaurant that the order hasn’t been started, we will refund your payment, but any discounts or vouchers used on that order will not be refunded. If you try to cancel after the restaurant has started preparing your food, you will still be charged the full price for the food. If the delivery driver has already been dispatched, you will also be charged the delivery fee.

The User accepts and undertakes:

Age restricted products can only be sold and delivered to persons aged 18 or over. By placing an order for an age restricted product, you confirm that you are at least 18 years old. Grab The bites operate the Challenge 25 age verification policy whereby customers who look under aged 25 will be asked by the delivery driver to provide proof that they are aged 18 or over. The driver may refuse to deliver any age restricted product to any person who does not look aged 25 unless they can provide valid photo ID proving that they are aged 18 or over. If delivery of any age restricted product is refused, you will still be charged for the relevant Item and for delivery.

  • The information provided to us is correct. The User is the only party responsible for any losses which may arise from any misinformation or inadequate information (ex. forgetting the password); and in these cases, his/her Account may be terminated.
  • You are fully responsible for anything you post, say, or upload on the platform. Grab the Bites is not responsible for any files or personal information you share. You must not use the platform in unauthorized ways, change its software, or use changed versions of the software. If you break these rules, you must cover any damage or loss Grab the Bites faces.
  • You must not send harmful, offensive, or illegal messages, or anything that goes against the laws of the UAE or international rules. Your messages, usernames, or comments must follow rules of decency and respect.
  • Do not threaten, harass, or bother other users or staff. Don’t do anything that could affect how others use the platform. You also must not post, share, or send anything illegal, offensive, or harmful to people or groups. You can’t advertise or sell things, take part in surveys, contests, or chain letters, or send harmful files or programs to others.
  • All of the records or materials obtained by using the services of Grab the Bites are within the consent of the user; the user shall be absolutely responsible for any damages, loss of information or other losses caused by them in the user's computer; the user shall not demand any compensation for any losses arising from the use of the service, not to use the services of the Platform for any commercial and advertising purposes without obtaining the consent of Grab the Bites. Grab the Bites may monitor all systems at any time or continuously.
  • The Platform can be used for business purposes but must follow the law. Don’t send illegal messages, chain emails, or harmful software. Don’t collect or misuse other people’s personal information. You are responsible for everything done using your username.
  • Customers must pay the service fee shown before delivery—otherwise, the order won’t be delivered.
  • Don’t use someone else’s account without their permission. Don’t use the Platform for illegal activities or copy content like menus or reviews. Don’t write fake reviews or blogs for personal or business gain that goes against the Platform’s purpose.
  • Don’t try to access other systems through the Platform without permission. Don’t interfere with how others use the Platform. Don’t upload viruses or anything harmful, and don’t harm or break the Platform’s security, systems, or partner networks.
  • All users who are minors in the jurisdiction in which they reside must have the permission of, and be directly supervised by, their parent or guardian to use the Platform or application. If you are a minor, you must have your parent or guardian read and agree to this Agreement prior to you using the Platform or application. Credit or Debit cards used in placing orders through the online payment gateway on the Platform must belong to the user. Otherwise, the user must obtain the legal permission from the card owner to perform the transaction.

You Are Not Allowed to:

  • Use the platform for anything other than its intended purpose (personal use).
  • Use it for business unless Grab the Bites approves it.
  • Break any local or international laws or regulations.
  • Sell or promote alcohol or prescription drugs illegally.
  • Violate copyrights, trademarks, or privacy rights.
  • Sell illegal items or promote illegal activity.
  • Send or receive money to/from countries or people under international sanctions.
  • Give false information about who you are or your business.
  • Support or fund terrorism in any way.
  • Sell drugs, steroids, or anything unsafe or illegal (including THC or CBD products).
  • Post or promote hateful, racist, violent, or abusive content.
  • Offer money services like check cashing, money transfers, or foreign exchange without a license.
  • Sell weapons, explosives, or related accessories.
  • Sell or issue travel visas or hospitality timeshares.
  • Promote or advertise someone else's product without permission.
  • Collect money without the required legal license.
  • Run pyramid schemes, Ponzi schemes, or other MLM-style programs.
  • Offer gambling, lotteries, fantasy sports, betting, or in-game gambling products.
  • Sell programs or materials promising quick wealth.
  • Offer unlicensed financial or investment services (like lending or pawning).
  • Run warning letter services, liquidation, or proxy businesses.
  • Trade in stocks, currencies, or offer FOREX services without approval.
  • Use illegal software or hardware mods (like for game consoles).
  • Sell tickets without a license or resell them illegally.
  • Sell fake or counterfeit goods (e.g., clothing or products).
  • Harass, insult, or behave badly towards grab the bites staff.
  • Be involved in activities linked to politically exposed persons (PEPs) with high-risk ratings.

Grab the Bites Can:

  • Suspend, block, or delete your account if you break any of these rules.
  • Take any other necessary action to protect its services and users.

If either we or you have any right to enforce these Terms against the other, that right will not be lost even if the person who has the right delays enforcing it or waives their right to enforce it in any instance. If a court or other authority decides that any part of these Terms is illegal or ineffective, the rest of the terms will be unaffected and will remain in force. We may change these Terms from time to time. If we make any changes which affect your rights in relation to our Service, we may or may not notify you. Changes to the Terms will not affect any orders you have placed where we have sent the Confirmation Notice. These Terms are governed by the law of the Dubai International Financial Centre, Dubai, United Arab Emirates (the “DIFC”) and you can bring legal proceedings in relation to our Service in the courts of the DIFC.

DATA

Other than personally identifiable information ("Personal Data"), which is covered under the Platform or application Privacy Policy, any material you transmit or post to this Platform will be considered non-confidential and non-proprietary. the Platform will have no obligations with respect to such material. the Platform and anyone we designate will be free to copy, disclose, distribute, incorporate and otherwise use that material and all data, images, sounds, text and other things embodied in it for any and all commercial or non-commercial purposes.

You are prohibited from posting, uploading or transmitting to or from this Platform any material that:

  • Breaches any applicable local, national or international law.
  • Is unlawful or fraudulent.
  • Amounts to unauthorized advertising; or
  • Contains viruses or any other harmful programs.
  • You may not misuse the Platform (including by hacking).
  • Any comments or feedback that you submit through the Platform must not:
  • Contain any defamatory, obscene or offensive material.
  • Promote violence or discrimination.
  • Infringe the intellectual property rights of another person.
  • Breach any legal duty owed to a third party (such as a duty of confidence).
  • Promote illegal activity or invade another's privacy.
  • Give the impression that they originate from us; or
  • Be used to impersonate another person or to misrepresent your affiliation with another person.

The prohibited acts listed in the above paragraphs are non-exhaustive. You will pay Grab the Bites for all costs and damages which it incurs as a result of you breaching any of these restrictions. Grab the Bites will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity or location of anyone posting any material in breach of the above paragraph.

Our Authority

  • Grab the Bites may temporarily suspend or completely cease the system operation at any time. the Platform shall not have any responsibilities against the Users of Grab the Bites or any third parties due to the temporary suspension or complete cessation of the system operation.
  • The username and password shall be displayed and approved by the registered Users.
  • Grab the Bites may prevent its registered Users who have created accounts on the Platform from creating new passwords or from using their old passwords for an indefinite period of time if it is deemed necessary by Grab the Bites.
  • Grab the Bites does not warrant that its services shall be provided on time in a secure and complete way, the results obtained from the services shall be correct and reliable, and that the service quality shall meet the expectations.
  • Grab the Bites has the right to back-up and delete all or some of the files, messages which are provided by the Users during the use of services for some periods deemed suitable by the Platform.
  • Grab the Bites shall not be held responsible for back-up and delete processes.
  • The Platform has the ownership and copyrights arising from the ownership of the information, documents, software, designs, graphics etc. which are produced by itself and/or bought from outside.
  • The sales of Grab the Bites are limited to the current availability of menus of the firms provided in Grab the Bites.
  • Grab the Bites is not responsible for any item ordered and not delivered by the Merchant due to unavailability.
  • Grab the Bites has right to post any information, documents, software, designs, graphics, etc. (such as the messages, poets, reports/news, file posted to the bulletin board) which are User generated and uploaded to the system by the Users and/or to transmit them to another place within the Platform deemed as appropriate by Grab the Bites. It is probable that this information is copied and/or posted by other users. In such cases, the users shall not demand any royalty from Grab the Bites.

  • Grab the Bites may provide transition for a User to other Platforms. In this case, the User agrees that Grab the Bites shall not be responsible for the context of the Platforms, which the User may access through its Platform.
  • Grab the Bites may change in time the services for which any Account is not required to a form, which requires Account. Grab the Bites may provide additional services, change some of the services partially or completely, or transform into a paid service.

Reviews are approved based on certain criteria. Reviewers must have had an experience with the Merchant firsthand, the one who placed an order can review the food.

CONTENT

  • Grab the bites is not obligated to approve every review on the Platform. A subset of the potential reasons for rejection are:
  • Offensive Language: Profanity, abusive, racist, and hate language is not tolerated in our interactive sections.
  • Irrelevant or non-indicative content.
  • Discrimination based on the grounds of religion, race, gender, national origin, age, marital status or disability.
  • References to illegal activity or uncorrelated references towards society's traditions and values.
  • Conflicts of interest: Competing Merchants are not allowed to post negative reviews. Violation of this might result in permanent removal from the Platform.
  • Allegations of health code violations.
  • Outdated and obsolete information.

Suspension And Termination

Grab The Bites has the right to terminate, suspend or delete your Account and your access to or use of the Platform, including any delivery service we provide to you in respect of an Order, for any reason, including, without limitation, if Grab The Bites , in its sole discretion, considers your use to be unacceptable, or in the event of any breach by you of these Terms. Where appropriate, Grab the Bites will give you the opportunity to state your position, before any termination, suspension or deletion of your account.

Failure to comply with our Terms of Use constitutes a material breach of the Terms of Use, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our Service.
  • immediate, temporary or permanent removal of any posting or material uploaded by you to our Service.
  • Issuing of a warning to you.
  • Legal action against you including proceedings for reimbursement of all costs on an (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary

For non-food orders—which include items purchased from categories such as groceries, flowers, electronics, and health & beauty—any request for cancellation, return, or refund will be handled strictly in compliance with the relevant consumer protection laws and regulations of the United Arab Emirates (UAE). These laws are designed to safeguard your rights as a consumer and ensure fair treatment in all transactional matters.

Please note that the term "non-food orders" specifically refers to any order placed under non-restaurant vendors or retail categories as listed above. If you are unsure whether your order qualifies, our customer service representatives will be happy to clarify this for you during your inquiry.

Price and Payment

Once your order has been accepted, this represents an agreement between you the User and the Merchant. The Merchant has sole responsibility for this order. Cash payments are made directly to the Merchant upon delivery to fulfill the order. Grab the Bites does not provide any payment service either to you or to third parties. All online payments are processed via your own issuer / payment service provider and the payment service providers in partnership with Grab the Bites. Prices quoted on the Platform shall be displayed in the applicable country's national currency and subject to applicable tax. You accept that prices and offers on the Platform may vary from the prices and offers offered by our Merchants elsewhere (including their own websites, mobile applications, or at their brick-and-mortar outlets).

The way we display the prices of our goods may vary depending on the Merchant, and, subject to applicable laws, the prices reflected on our Platform. Prices and additional charges (including but not limited to Delivery, Small Basket, Service fees, or Cash on Delivery fees, service fees) indicated on the Platform are as at the time of each Order and may be subject to change later. Grab the Bites reserves the right to charge fees (including but not limited to Delivery, Small Order, Service fees, or Cash on Delivery fees) for our services as we deem necessary for our business. The breakdown of the prices and additional charges (including but not limited to Delivery, Small Order, Service fees, or Cash on Delivery fees) are displayed before checkout. When you place an Order, you agree to all amounts, additional charges and the final ‘Total' amount which is displayed to you.

Payment Methods

When using your Account as payment instrument you may choose from different payment methods as available and indicated on the Platform. Grab the Bites reserves the right to offer additional payment methods and/or remove existing payment methods at any time at its sole discretion. If you choose to pay using an online payment method, the payment shall be processed by our third-party payment service provider(s). With your consent, your credit card / payment information will be stored with our third-party payment service provider(s) for future Orders. Grab the Bites does not store your Full credit card or payment information we may store credit card number only. You must ensure that you have sufficient funds on your credit and debit card to fulfill payment of an Order. Insofar as required, Grab the Bites takes responsibility for payments made on our Platform including refunds, chargebacks, cancellations and dispute resolution, provided if reasonable and justifiable and in accordance with these Terms at the time of checkout, please read the applicable payment terms linked and disclaimers carefully before using any payment method

Tips

1. General Overview

Grab the Bites offers customers the option to show appreciation for delivery riders through voluntary Delivery Rider Tips, which are additional payments made at the customer’s discretion. These tips are not mandatory and are separate from the delivery or item charges.

A " Delivery Rider Tip" refers to a monetary gratuity paid by a customer through the Grab the Bites Platform to the delivery rider assigned to complete an order.

2. Eligibility and Applicability

  • The Rider Tip feature is available for all orders placed through the Platform, except:
    • Orders paid for via Cash on Delivery (COD).
    • Orders delivered directly by the Merchant instead of a Grab the Bites-assigned rider.
  • The Rider Tip is offered as an optional feature at checkout, and payment is collected using the same payment method selected by the customer for the order.
  • 100% of the Rider Tip amount is transferred to the rider once the delivery is successfully completed. Grab the Bites does not retain any portion of the tip. Which may subject to change anytime.

3. Refund Policy for Rider Tips

  • In the event of a cancelled order where the customer is eligible for a refund as per the applicable cancellation provisions in Grab the Bites’s Terms and Conditions:
    • The Rider Tip amount will also be refunded.
    • By default, the refund will be issued as Grab the Bites credit unless the customer specifically requests a refund to the original payment method.
    • If requested, the refund will be processed back to the original payment method used during the order.
  • Refund Processing Time:
    • Refunds may take between 7 to 14 business days, depending on your bank or credit card company.
    • For international banks, processing time may extend to up to 30 days, due to varying banking procedures and timelines.

4. Post-Delivery Tip Option

  • After receiving an order, customers may be presented with a follow-up prompt to leave a Delivery Rider Tip.
  • If the customer chooses to provide a tip at this stage:
    • The payment is processed on behalf of the rider by Grab the Bites, acting as their limited payment collection agent.
    • The tip will be treated as a direct payment from the customer to the rider.
    • Grab the Bites may share the customer’s first name with the rider as part of the tip notification.
    • This post-delivery tip is non-refundable and does not form part of the main order.
  • Depending on the payment method used, this post-delivery tip may appear as a separate charge on your bank or card statement.

5. Customer Support for Tip Issues

For any questions, concerns, or disputes regarding Rider Tips, customers are encouraged to contact Grab the Bites’s customer support via:

  • The in-app live chat feature, or
  • Email correspondence through the official customer support channels listed on the Platform.

Records and Law

Governing Law and Dispute Resolution

In the event of any dispute arising in relation to these Terms, the User hereby agrees, acknowledges, and confirms that all accounting records, microfilm and microfiche copies, and computer-based records maintained by Grab the Bites shall constitute valid, binding, conclusive, and exclusive evidence. This clause shall be deemed an evidentiary agreement under applicable law. The User explicitly and irrevocably waives any right to dispute such records and further waives the right to request an oath or challenge the validity of such records on the basis of how they are maintained.

These Terms shall be governed by, and construed in accordance with, the laws of the United Arab Emirates. Any disputes arising in connection with these Terms, including any non-contractual disputes, shall fall under the exclusive jurisdiction of the courts of the United Arab Emirates.

Furthermore, for matters specifically related to the use of the Platform or services, the courts of the Dubai International Financial Centre (DIFC) in Dubai, United Arab Emirates, shall have exclusive jurisdiction. Any dispute or claim (contractual or non-contractual) related to the interpretation, formation, or application of these Terms shall be governed by the laws of the DIFC.

Severability & License

Severability, Use Restrictions, and Intellectual Property Rights

If any provision of these Terms is determined to be unlawful, void, or otherwise unenforceable for any reason, such provision shall be deemed severable from the remainder of these Terms and shall not affect the validity or enforceability of the remaining provisions. No waiver by Grab the Bites of any breach or default shall be construed as a waiver of any preceding or subsequent breach of the same or any other provision.

Grab the Bites hereby grants you a limited, revocable license to access and view the Platform and to download, email, share via social media, or print individual pages from the Platform, solely for your personal, non-commercial use, and strictly in accordance with these Terms. This license is subject to revocation by Grab the Bites at any time, with or without cause. You may not remove or alter any copyright, trademark, or proprietary notices contained on such pages.

Unless explicitly permitted by Grab the Bites, you are prohibited from incorporating any information, content, or materials from the Platform into any database, compilation, archive, or cache. Furthermore, you may not modify, copy, distribute, republish, transmit, display, perform, reproduce, publish, reuse, resell, license, create derivative works from, transfer, or sell any information, content, material, software, products, or services obtained from the Platform, except as expressly authorized herein.

You may, however, share links to the Platform or engage with it via social networking features provided or referenced on the Platform (e.g., becoming a "fan" or follower), in accordance with these Terms.

Rewards by Grab the Bites – Simplified Terms & Conditions

  • Eligibility
    Only invited, registered users in the UAE can join the GTB Rewards program. Eligibility may change over time.
  • Acceptance of Terms
    By using the rewards program:
    • You agree to these terms.
    • You allow the use of your personal data for program purposes.
    • You agree to the Company’s Privacy Policy.
  • Program Changes
    The Company may change or cancel the program, its benefits, or these terms at any time without notice. Members are responsible for staying updated. If the program ends, unused points will be lost.
  • Termination
    The Company can cancel your membership if you breach the rules, act fraudulently, or provide false info. In such cases, all points and benefits will be lost.
  • Earning & Redeeming Points
    • Earn 10 points for every AED 1 spent on the app (within the UAE).
    • Points can be redeemed for credit, offers, or rewards shown in the app.
    • Rewards cannot be returned, exchanged, or redeemed for cash.
    • Once redeemed, orders cannot be canceled or changed.
  • Point Expiry
    Points are valid for 60 days from the date they're added to your account.
  • Membership Use

  • Cancelled or Delayed Orders
    • If you cancel or change an order, earned points will be removed.
    • No extra points are given for late deliveries.

Merchant Responsibility

Merchants are solely responsible for the preparation, condition, and quality of the goods sold. In cases of merchant-handled deliveries, Merchants are also solely responsible for the delivery of the goods and/or orders. Grab the Bites shall not be held liable for any loss, damage, cost, or expense resulting from your contractual relationship with a merchant.

E-Gift Card Disclaimer

Grab the Bites shall not be liable, whether in contract, tort (including negligence), or otherwise in connection with the use or provision of E-Gift Cards, for:

  • Any economic losses, including but not limited to loss of revenue, profits, contracts, or anticipated savings.
  • Any loss of goodwill or business reputation.
  • Any special, indirect, incidental, punitive, or consequential damages.

If an E-Gift Card is found to be non-functional, the sole remedy available to you, and the sole liability of Grab the Bites, will be the replacement of the E-Gift Card. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence or fraud.

Indemnification

You hereby agree to indemnify, defend, and hold harmless Grab the Bites, along with its parent company, subsidiaries, affiliates, directors, officers, agents, employees, and authorized representatives, from and against any and all claims, demands, actions, liabilities, losses, damages, costs, or expenses (whether direct, indirect, incidental, consequential, or otherwise), including but not limited to reasonable legal and attorney’s fees, arising from or related to:

  • Your access to or use of the Platform, including any content, data, or information transmitted, uploaded, or submitted by you.
  • Your violation of these Terms and Conditions, or any breach of applicable laws or regulations.
  • Any submission or communication made by you that is alleged to infringe upon the intellectual property rights, proprietary rights, privacy rights, or any other legal rights of any third party.
  • Your acts or omissions in connection with your use of the Platform, including but not limited to interactions with merchants, third-party services, or other users.

  • User submissions and interactions.
  • Multimedia content such as text, images, graphics, audio files, and video.

To the maximum extent permitted under applicable law, Grab the Bites explicitly disclaims all representations and warranties, including but not limited to:

  • Express warranties (e.g., representations about availability, accuracy, or reliability of the Platform’s content or services);

    • Merchantability (fitness for general use).
    • Fitness for a particular purpose.
    • Title and non-infringement.
    • Security or freedom from computer viruses or other malicious components.
    • Any warranties arising from a course of dealing, usage of trade, or course of performance.

Grab the Bites does not guarantee that the application will be uninterrupted, secure, error-free, or that any defects will be corrected, nor does it warrant that the Platform will meet your expectations or requirements. These terms shall be available in both English and Arabic. In case of any discrepancies between the two versions, the English version shall prevail.
